NSW · FIXED TERM

A fixed term ending does not mean both sides use the same notice rule.

A NSW tenant can use the end-of-fixed-term pathway with the current minimum period, while a landlord must use a permitted ground and the applicable notice period.

Tenant end-of-fixed-term path

A tenant can use the current 14-day end-of-fixed-term pathway, with the written agreement end date still relevant to the final date.

Landlord permitted-ground requirement

A landlord must select a current permitted ground and satisfy that ground’s period and evidence requirements.

Why no-grounds eviction removal matters

Fixed-term expiry is not a standalone generic no-grounds landlord pathway under the rules applying from 19 May 2025.

What happens if the tenant stays

A notice does not itself resolve every possession issue. The parties may need the official Fair Trading or Tribunal process if the property is not vacated.

Early exit after landlord termination notice

A qualifying fixed-term tenant who has received a landlord termination notice can use the separate 14-day early-exit pathway.

The calculator separates tenant and landlord paths, resolves service first, counts the applicable calendar days and compares the result with the fixed-term details entered.

Common questions

Can a tenant leave at the end of a fixed term with 14 days notice?

Fourteen days applies to several paths, but not every path. Select the actor, agreement and ground before relying on that period.

Can a landlord simply refuse to renew at the end of a fixed term?

Fixed-term results depend on who gives notice and the selected ground. Some pathways cannot end the agreement before its stated end date.

Does the landlord need a ground?

NSW landlords must use a current permitted ground. The calculator does not offer a generic no-grounds landlord path.

Can notice be given before the fixed term ends?

Fixed-term results depend on who gives notice and the selected ground. Some pathways cannot end the agreement before its stated end date.

What if the landlord gives notice and I want to leave earlier?

The answer depends on the state, person giving notice, agreement type, ground and service method. Use the calculator, then check the linked official source.
